Transport Accident Claims

Case

Highlights

Our client suffered an exacerbation to her left knee as a result of a t-bone accident. The TAC denied liability for the knee and therefore refused to pay for the surgery her treating health practitioners had recommended. Our office filed a dispute with the TAC, obtained relevant and supportive medical evidence, and convinced the TAC to accept liability for the knee and to pay for all future treatment

Client entitled to medical and like expenses.

The Challenge

Proving that an accident caused an exacerbation or worsening to our client’s knee condition relied heavily on the medical evidence. That being, comparing the pre-accident medical picture to the post-accident medical picture.

Legal Strategy

Our team had to ensure we asked the right questions to the right doctors, eliciting the answers required to substantiate to the TAC that the accident was causative of our client’s condition.

Results

The client was entitled to a back payment of medical expenses, and ongoing entitlements under Transport accident legislation.
