What Can You Claim?

Let’s break down the four key categories.

1. Medical and Like Expenses tac claims covers “reasonable and necessary” medical costs, such as:

  • Hospital and GP visits
  • Surgery and rehabilitation
  • Mental health support
  • Allied health (e.g. physiotherapy, OT)
  • Home help, nursing care, and transport There’s no fixed limit for these, but TAC does apply caps and pre-approvals in certain situations.

2. Weekly Payments If you can’t work due to your injury, TAC can replace up to 80% of your pre-injury average weekly earnings (PIAWE), with a maximum weekly cap (currently approx. $1,540). These payments come in three phases:

  • First 13 weeks: 80% of your PIAWE
  • Weeks 14–130: Up to 80%, based on capacity for employment
  • After 130 weeks: Only if you have no capacity to work.

3. Impairment Lump Sum This is a one-off tax-free payment if your permanent impairment is assessed at 11% or more (under AMA Guides).

  • The more serious your injury, the higher the lump sum
  • The current maximum is over $380,000
  • You don’t have to prove fault
  • This is in addition to other TAC benefits Example: A spinal injury assessed at 20% impairment may attract a lump sum between $35,000–$50,000.

4. Common Law Claim If another party’s negligence caused your injury, you might be eligible for additional compensation. This includes:

  • Pain and suffering damages
  • Future loss of earnings

You must meet the serious injury threshold, which could include:

  • Long-term impairment
  • Major psychological trauma
  • Permanent lifestyle impact Successful common law claims can result in payouts of hundreds of thousands of dollars, and this amount is separate from your impairment lump sum.
How Is Your Compensation Calculated?

The TAC Claims uses your medical reports, employment history, and functional assessments to determine:

  • Whether you meet eligibility for lump sums
